Scalia announced his complcity in this policy during an interview. He attempted to use the contorted “Logic” that torture is ONLY a form of punishment and since these detainees had not been found guilty of a Crime to be punished- the actions did not constitute torture. He never did provide the ‘legal’ term that describes using such techniques to elicit confessions or Intel.
Does anyone really think Cheney didn’t Cover His Ass with at least one SCOTUS? Another ‘Capo’ layer to insolate himself from prosecution? He had the Sec of Def, Nat Security Advisor,the Directors of AG, CIA and of course POTUS…Why would he not secure a Seat From the Bench as well? A hunting Trip? Or Didn’t Scalia need that much ‘encouragement’ to ignore legal precedence.Who outranks whom on the Question of Constitutionality? Office of Legal Council, AG Or A member (or two) of SCOTUS?
War Crimes,Crimes against Humanity and Treason have no expiration dates. Even if Cheney finally drops over dead - he should be tried in abstentia.If for no other reason to stop his psychotic daughter in her political tracks! She is clear proof such atrocities and tyranny can happen again in, and By, this country.That Nut didn’t fall far from the Tree!
But reality is that the Economy, 2 wars, healthcare, Banking/Investing Reform, consumer/labor protection legislation….Are unaviodable Priorities to get US back up on our feet. The Crimes of the past aren’t going anywhere.Haste makes Waste- lets take our time, do it right and Get Them All-Every Crime by Every person!
