Top Court Orders New Hearing for Troy Davis

Death row inmate Troy Davis might get a chance to clear his name in the 1989 murder of a Savannah, Ga., police officer, now that the Supreme Court has ordered a federal judge to grant him a new hearing.  —KA

AP via Google News:

The court told a federal judge to hold a hearing to decide whether evidence “that could not have been obtained at the time of trial” could establish Davis’ innocence. His case has become a rallying cry for death penalty opponents.

Davis’ attorneys contend he deserves a new trial because new evidence proves he was mistakenly identified as the killer. They say several trial witnesses have recanted their testimony, and others who did not testify during the trial have said another man confessed to the killing.

“This is exactly what we asked for,” said Jason Ewart, Davis’ attorney. “It’s been years since these witnesses have come forward, and they’ve never had their day in court. And now they will.”

Isn’t it truly amazing how the so-called “conservative” justices support the right to life ?  Of course, they don’t count capital punishment or unjust war or the lives on non-US-citizens anywhere on the globe.

... proving the incredible depths to which this man will plum.  This is the man who argued that as torture was being widely used that it couldn’t be considered cruel AND UNUSUAL and so wasn’t a constitutional issue.

20 years ... wow.

All credit to Troy Davis and his admirable sister (who has kept up the fight along with others).  May justice be achieved in this new trial.  Quickly.

Assuming the initial indications are correct and that he will be aquitted, it is hard to imagine how Mr Davis will be after this ordeal.  It will certainly dominate and define his life.  Hopefully he will be able to make SOMETHING positive of the experience and to enjoy many productive and enjoyable years.

It’s outrageous that it took this long, and the way that his execution was stayed just hours before, over and over again, playing this man like a yo-yo, is disgusting. Of course he will be acquitted, there never was any concrete evidence against this man!

If justice is to be unbiased, fair and based on facts, and the evidence presented in a case, then what logic is there in a judicial system that adminsters a verdict of guilty and then on the discovery of false evidence and/or testamony at a latter date, refuses to review the case, evidence and testamonies?

It is a system that has failed, a system where prosecutors seek to win by any means when they should be seeking the truth and pressing for justice with mercy but instead are concerned with competing for winning numbers and political points for career advancements or political appointments or even to run for office. This would be a corrupt system. There are some shining lights in the darkness and hopefully this will be one.

Troy Davis and all accused deserve justice and the right to prove their innocents.
