15 or Not, Alleged Pirate Will Be Tried as Adult

In this New York courtroom sketch, piracy suspect Abdiwali Abdiqadir Muse cries as the judge asks his lawyer about Muse’s family and age.

Whether or not Abduwali Abukhadir Muse is 15, as his father claims, he will be tried in New York as an adult for his alleged role in holding an American ship captain as a hostage. Muse’s mother, on the other side of the world, has asked President Obama for mercy, or to at least let her be with her son.

In what could be the first U.S. piracy case in 100 years, the judge ruled that Muse’s father was not credible in determining his son’s age.

Washington Post:

A court-appointed attorney said Muse’s father gave his birthday as Nov. 20, 1993, which would make him 15. But prosecutors have said Muse has told them he is of majority age, which would exempt prosecutors from extra legal steps to try him in an American court.

Magistrate Judge Andrew J. Peck said in court Tuesday afternoon that he spoke to the defendant’s father in Somalia by telephone through an interpreter and determined that the father is not a credible witness. The judge ruled that Muse is of majority age and thus can be tried as an adult.

Yet again, “The Contingent” are apologists for criminals.
1) The FATHER claims his son is 15 knowing that in the US 15 usually means “child” and family court—but FolkTruther believes the guy is telling the truth, even tho the son says he’s 18.
2) The hijacked ship’s crew all insists this guy was the ringleader.
3) Piracy is now…justifiable in FolkTruther’s twisted logic.
4) To FolkTruther, an 18 year old pirate with a Kalishnikov held to an unarmed seaman is a hero, but an 18 year old soldier with am M-16 held on a civilian Iraqi or Afghani is a war criminal.

TC is plain, old f***ed up.

Holding a 15 year old or 16 year old as an adult is certainly questionable. Factorinig in the ignorance of the masses of people in Somalia and the poverty, which may or may not be increased by the highjacking of Somalia’s fisheries by international fish piracy, should the American People be spending their tax money on prosecuting this child.

While criminals like Bush and Cheney can walk after lying the country into a war costing 100,000s Iraqi lives and thousands of American lives, how can a 15 year old be held accountable for something he was moved into doing by adults? Bush and Cheney and their enablers have bankrupted the country and we are supposed to believe that they are too important to prosecute, but a 15 year old should be in the slammer. I suppose the 15 year old should have killed some one and then perhaps he too would be free from prosecution.

How do you know there wasn’t a gun pointed at the kid REQUIRING him to point the gun they gave him at the hostage?

The laws prohibiting TORTURE are ALSO international, and apply to ALL countries, including the US.

You aren’t REALLY for enforcement of international law, ARE you?

Nor are you REALLY for knowing what you’re talking about before opening your bravous Keyboard Kommando yap from the safety of your bedroom.

Scorpionnet, Thank you for your post.  I did’nt know that left wing lawyers chased fire trucks before.  What the rest of us our concerned with is the barbarism of treating the alledged crimes of children as if they were adults. This includes the crimes of child soldiers, of which there are many in Africa.

When you are photographed carrying a fully loaded Kalashikov AK-47 military grade fully automatic assault rifle pointing at an unarmed civilian held hostage in the international high seas you get charged with INTERNATIONAL piracy, a law universal to all countries. You go to jail! This is no monopoly game. What is it that pirate supporters at Truthdig and those firetruck-chasing left-wing lawyers don’t get?

ironically, the same people who posted this story, with comments about how can we not believe this kid’s father and mother that he is a great kid and is only 15, are the same people who posted a story about the Craigslist killer and the implication that the people who knew this man really didn’t know him and should be ignored.

The hypocrisy on this site continues….

My thinking mirrors the start of Squeaky Jones’ comment.  I was wondering if the 15 year old has been or will be tortured?  What does that say about the US justice system?  Adding on to another comment, about 15 year olds who were judged guilty of crimes who are on death row as adults.  Also, there are kids who were judged “guilty” for crimes as teens who can/are receiving life sentences.  That’s “not supposed to be”. The law excludes children from adult judicial pathways.

Even the age is “flexible” by a judge and who is an adult in recent years.  Our prisons are full based on injustice of many kinds.

The barbarism of the US criminal system is beyond dispute.  There are two dozen persons incarcerated for life without parole who alledging committed crimes when they were under 15 years old.

Seriously, do they really think this kid was the ringleader of the pirates who seized the captain’s ship? I’m appalled by the treatment this kid is going through. With the atrocity that the west is committing in Somalian waters and what the US did during the Somalian civil war, I just can’t stand this kind of injustice. This angers me very much.

Who else knows you better then your own Mom, and Dad. I have a strong feeling this kid has been ruffed up(tortured) already. Also, I like Mr. Fish’s cartoon, “One Mans Piracy” of the difference between somalian piracy and American piracy? Inc. Squeaky.

President Barack Hussein Obama Should Pardon Abdiwali Abdiqadir Muse

“Based on?”

“A greater good.”

“Which is?”

“Peace on earth and goodwill to all living beings.”

“Brought about how?”

“Actions by our government which show the world that there’s been a complete turnabout in our relations with the rest of the world.”

“What will be the quid pro quo?”

“And end to piracy in that region.”

“Anything else?”

“President Obama reassigns the U.S. Naval vessels now engaged in countering piracy to the task of tracking down and chasing away any and all foreign ships which are carrying out unauthorized fishing or polluting the waters off the coast of Somalia.”

“The reason being?”

“It’s the decimation of Somalia’s fishing industry that’s driving its young men into piracy.”

“And the effect said pardoning will have upon U.S. relations with the Arab/Islamic nations?”

“Breathtaking.”
