Acquittal in Wedding Day Shooting Sparks NYC ProtestsPosted on Apr 26, 2008
Vowing that “this city is going to deal with the blood of Sean Bell,” the Rev. Al Sharpton joined hundreds of New Yorkers in a march through Harlem to protest this week’s acquittal of three police officers involved in the 2006 shooting that claimed the 23-year-old Bell’s life and injured two friends on his wedding day.

Maybe more people would start taking Al Sharpto seriously if he didn’t play the Politically Correct game of only protesting against easy targets. Why is it that Al Sharpton is perfectly OK with having famous and successful black men like Chuck Berry and Jack Johnson thrown in jail for violating the Mann Act, when a proven guilty rich white boy like Eliot Spitzer avoids punishment? Is Sharpton not aware that the Spitzer family has a decades long tradition of being members of the racially biased Harmonie Club on Manhattan’s Upper West Side? Why is Al Sharpton pulling his punches against Eliot Spitzer, the corrupt New York official who put more young black men in New York State prisons using Rockefeller’s drug laws in the last year than have died in Iraq, Afghanistan, and gang shootings over the last decade. Hey Al, why not call for a Special Prosecutor to examine Eliot Spitzer’s decades long business with the prostitution wings of a few Organized Crime families? Only a special prosecutor would be able to uncover the links between the $500 Million dollar Spitzer family fortune and the organized crime complaints which Eliot Spitzer suppressed when he was NY Attorney General.

Mr. Giacobbe is a she with a dubious character. She wrote at the end of a rant to me: “I am Sicilian female. Don’t mess with me, or I would break your head.” Literally, “don’t break my dick.” She sent me a subtle threat as being a Sicilian “Mafia.”
Since you want to be so polite to her by addressing her with “Mr.”, I thought that your politeness should be addressed in the right gender.

Mr. Giacobbe, I was recommended this site for the same reasons you state, and the same reasons illustrated--continually--by ITW. Many other sites are as you say, laden with vitriol and meandering minds. TD has changed somewhat since I started reading a year ago. HOWEVER, it is still worth the reading and participating because ITW is not alone in presentation, there are many others who frequent this site, and so, worthy of staying the course.

We are never going to have a rational discussion of how “policing powers” can be used for good, or abused.
It seems that every time this subject surfaces, it is shouted down from the left and the right..Rubin Carter Patterson, Greensboro,Daley’s goons in Chicago, Move-Philadelphia, Rodney King L.A. Katrina-New Orleans, Howard Beach, Abner Louima & now Sean Bell in New York.
It would seem that the time for a discussion on how to “regulate” law enforcement is long past due, BUT as I say, it just becomes a shit-fight. In my experience the only way to “win” a shit-fight is be the first to leave....bye!

Before you run off and make this incident a racial issue I would like to inform you that not all of the officers were white. Thus, I don’t see how you can blame the outcome of the case on race. If both the defendent and the victim were black then no matter what the outcome a black person would “win.”
While there may be other factors or instances of the case to blame, race is not one of them. I think it is a travesty of justice that anytime someone of color is killed and the defendent is not found guilty it is “racially motivated.” It is this kind of thinking that keeps America from moving forward.

ITW:
I don’t think your being completely intellectually honest here.
The three officers and their lawyers “gamed” the system as so many people do, and it worked.
First, they chose not to undergo a jury trial because they knew that, even if an impartial jury could be empaneled, they stood far less of a chance against twelve than against one.
Second, the officers did not testify in their own behalfs. And contrary to your assertion, this was because their stories did NOT jibe completely; e.g., only one of the other two officers heard Det. Isnora identify himself as a police officer before firing.
Third, let’s be honest about Judge Cooperman: he may be a “veteran,” but that wouldn’t make him any less “prejudiced” if he is. In this regard, it is notable that he stated in his decision that he considered “the criminal backgrounds and demeanors” of Guzman and Benefield in making his decision. This is completely contrary to the propre adjudication of law: a judge ALWAYS instructs a jury that these things are NOT to be considered in their deliberations (I have been on juries and have heard this from each judge) - particularly when the officers themselves were not aware of the criminal backgrounds of Guzman and Benefield when the incident occurred.
And that is just one error among other errors and inconsistencies in the actual decision.
Peace.

I find the presumption that NYC police officers will always get off disgusting.
Justin Volpe is serving a 30 year sentence for sodomizing suspect Abner Louima with a broomstick so badly that Louima needed internal surgery.
Thomas Weise, Thomas Bruder amd Charles Schwarz were all convicted of a criminal coverup.
Read the verdict! And then go read the Constitution. The judge said very precisely that there was insufficient evidence to establish guilt beyond a reasonable doubt.
That’s the gold standard (or supposed to be) of criminal justice. The defence doesn’t have to do anything--the prosecution must demonstration beyond a reasonable doubt that the defendent is guilty. Otherwise, by our law and our standards, he must be found Not Guilty.
I’m sure Fadel doesn’t have a clue to how American justice works when it’s working correctly...Cops kill Black suspect--they MUST be guilty.
And stop with the straw man that these cops are heroes to right-wingers. They are not. Clearly, even under their story, they f***ed up bigtime. But is that ipso facto a crime or simply a tragedy? There’s no guarantee these cops won’t be disciplined, or even dismissed. And they probably deserve that.

Even if one or two of these could be excused, or even justified, there is clearly a pattern here. How many times must “better training and oversight” be suggested before they actually occur? Or is it that the NYPD simply doesn’t care?

In Defense of Truthdig!
Vomits Robert Giacobble:
“I repeat: Truthdig should be renamed “AgendaSpin” or “SmearDig” because I rarely ever see anyone actually presenting the truth.”
=======================================
I write this piece mainly in defense of the enlightened forum Truthdig against the rabid attacks of this villain who started this when he came in defense of his other beget comrade Frank; both of which are, at best, petty-minded individuals who write incoherent rants in defense of injustice and savagery killings. And I dare to say that both of them are the worst bigots-racists who exemplify all what is wrong with these sad United States of America.
They started by defending the brutality and savagery of the NY police. And to add insult to injury, they moved to attacking and belittling the victims of this savagery and brutality, and by extension attacking Al Sharpton, Farrakhan, Douglas Chalmers, myself and finally Truthdig, and by extension attacking everyone who expresses any view not to their liking.
I can bet my life on it that these two individuals never before had an open forum where they got the opportunity to express their views, never mind how hateful, incoherent and irrational they are. To use the metaphor of the ungrateful animal that bites the hand feeding it, one can gain great insight into what types of dubious characters these two individuals have. Earlier, and on another thread, Frank started a vicious rabid attack against Islam, profiling my name, ethnicity and religion, and when I called him a hateful Zionist bigot, he raised a hell, to be followed by the hell raised now by Robert Giacobble, who is escalating his attacks against the only forum which allowed them a chance for their rants.
The labels racists, bigots, fascists, Zionists, KKK, might not all technically apply to both of you Frank and Robert, but at least two of these labels fit your ugly hateful thought.
I’ve been writing to newspapers, magazines, and Web Sites for over thirty years now. Though I managed to get my views published in major newspapers and some magazines, in three languages, scores of times, I never experienced the facility of expressing my views through Truthdig. If there is a forum that epitomizes the concept of free speech, then that forum is Truthdig, and the best proof of that is that they even tolerate the garbage thrown at them by deviant minds like Frank and Robert.

Isn’t it amazing how fear can trigger hatred, and hatred can trigger rage, which immediately calls on all the buried stupidity, prejudice, violence and racism.
Then after the fact and the deed is done, lacking the fundamental courage to confront said fear, hatred and rage, [let alone acknowledge their guilt] those who lost whatever control they had blame their victim. Which feeds the buried fear, that leads to the inevitable repeat of the loss of control.
I suspect this isn’t the first, nor will it be the last time these cops have lost control.
And as usual defenders of bad behavior jump to defend the indefensible. Screaming loud and clear through the facade of really caring about justice, or much of anything else, for that matter.
Truth is some folks want justice only for those they determine are good enough to be almost as good as them.
What’s that old saying? Oh yeh, consider the source.
“A veteran NY state judge, trained in adjudicating just such complex situations ...”
Oh thanks for that insightful and INCREDIBLE observation Robert Giacobbe!
Friends don’t let friends drive drunk. And friends shouldn’t let friends walk away from responsibility. Refusing to demand accountability serves no good purpose and pretty well guaranties the wrong done will be done again.
Incredible!
“Before we pin medals on the defendants for their heroism, let’s look at what they did,” said prosecutor Charles Testagrossa. “Two full magazines poured into a motionless vehicle of unarmed passengers speaks of rage.”
Thanks for that quote DC. Pretty well sums up the condition of the offending cops, huh. That condition called, “I got the gun and you’re the wrong color.” Or maybe, “In case we got the wrong guy, lets just make sure no-ones left standing.”
Trained “… in adjudicating just such complex situations ...” eh? Well yes, I would say if the victims were black and the offenders were cops, the judge sought is just going to have to be someone whose been well-trained in tolerating racism and bad cop, white-washing. Yep. And you don’t have to be any special color or a rocket scientist to figure that one out.
Just glad I don’t have to go there [New York City] anymore. Not because of my color or whether or not I may or may not encounter drug dealers or bad cops. But just because when a grave injustice is done, it tends to pollute the surrounding environs. If that’s what I want, I can always visit inside the belt-way.
Will we the people of the United States ever overcome the sewage we waddle in? Will we ever, ever be able to overcome the disgraceful heritage we celebrate?
Fear, hatred, racism, war, murder, drugs, plunder and greed. And shopping for the “right” justice should we happen to be exposed in our dirtiness.
My heart goes out to the Fiancé, and the family members of the victim[s] of this crime. And if my compassion offends anyone, all I can say is good!
Wear your “mark” with the false pride it deserves.

Quote LATimes: “Before we pin medals on the defendants for their heroism, let’s look at what they did,” said prosecutor Charles Testagrossa. “Two full magazines poured into a motionless vehicle of unarmed passengers speaks of rage.”
From Wiki:-
The New York Post reported that, according to an unnamed undercover officer, Guzman had an argument inside the club with a woman and threatened to get a gun. One of Bell’s friends was heard to say “yo, get my gun” as they left the scene. Fearing a shooting was in the making, the Undercover Detective followed them to their car while alerting his Backup team that they were possibly retrieving a gun from the car, prompting the team to confront Bell and his companions before they could leave the scene. The undercover officer followed the group and Bell was ordered by the officer to raise his hands after getting in his car. Instead, Bell accelerated the car and seconds later hit an unmarked police minivan. A toxicology report reportedly showed that he was legally drunk at the time of the shooting........
Critics suggest that the scenario was concocted by the police officer in order to justify the shooting. Columnist Juan Gonzalez reported in the New York Daily News that, according to a law enforcement source, in the hours immediately following the incident, there was no mention of a fourth man in the police calls and no search was launched for the potentially armed man. This source thus contradicted initial reports that the police searched the neighborhood for the missing man......
In an interview on Larry King Live, accompanying Bell’s fiancée Nicole Paultre, Al Sharpton stated that according to his conversations with eyewitnesses, none of the three men who were shot mentioned a gun while leaving the club. Sharpton also felt that it would be impossible for the persons in the car to have heard the police from within the car, and that they were likely to fear that they were being car-jacked.......
According to Police Commissioner Raymond W. Kelly, veteran officer Michael Oliver emptied two full magazines, firing 31 shots from a 9mm handgun and pausing to reload at least once. Some shots hit nearby homes and a train station. Five of the seven officers investigating the club were involved in the shooting........
An autopsy showed Bell was struck four times in the neck and torso. Guzman, 31, was shot 19 times and Benefield, 23, who was in the back seat, was hit three times........
That all looks kind of like the undercover guys were most probably drunk themselves and picked a fight with one or more of the victims in the club or before, then eventually followed them outside but also set up the backup team with a false alert on ‘something’ happening.
Obviously, Oliver who was the most experience and should have been the most responsible went beserk and there must have been a reason for that. He’d obviously set it up with the full intention of wiping out everyone in the car and didn’t even care about any people in the background, uhh!! http://en.wikipedia.org/wiki/Sean_Bell
