The Department of Homeland Security has received approval from Congress to ignore dozens of environmental laws in order to construct a 670-mile border fence. Environmentalists are worried about the impact the project could have on endangered species, and several property owners have attempted to obstruct the construction process.

This represents an unprecedented abuse of authority on Secretary Chertoffs part, and clearly demonstrates the need for an immediate repeal of section 102 of the Real ID Act. Obeying the law is not voluntary, it is mandatory, and Secretary Chertoff cannot claim that he is sweeping aside a host of laws on the border in defense of immigration laws. In a nation of laws all laws must be respected, not just those that are convenient.
Equal protection under the law is meant to be a fundamental right shared by every American, but the Real ID Act makes the legal rights of citizens who live near the border conditional on Secretary Chertoffs whims. Section 102 of the Real ID Act of 2005 states, Notwithstanding any other provision of law, the Secretary of Homeland Security shall have the authority to waive all legal requirements such Secretary, in such Secretarys sole discretion, determines necessary to ensure expeditious construction of the barriers and roads under this section. No one else is granted this extreme power under any circumstance. The president cannot waive our nations laws even in times of national crisis, and Secretary Chertoff cannot waive the laws that protect citizens who live away from the border. Only border residents may have their legal protections waived.
In announcing the Real ID waivers Secretary Chertoff said, “Criminal activity at the border does not stop for endless debate or protracted litigation.” The waivers are essentially an admission that the border wall will itself violate up to 36 federal laws, making construction of the wall a criminal act. If Chertoff is genuinely concerned with criminal activity he should ensure that the agency that he oversees complies with the law.
The only reason for Secretary Chertoff to waive these laws is because he knows that the border wall will violate them. In setting these 36 federal laws aside Secretary Chertoff sets himself above the law. If congress allows unchecked power to remain in the hands of an unelected administration appointee they are complicit in fundamentally undermining the rule of law. Leaving the Real ID Act on the books and allowing Chertoffs waivers to stand sets a precedent that should outrage the American people. If our nations laws can be set aside to build a border wall today, they may be similarly set aside for whatever crisis politicians discover in the next election cycle.

You’re oh so right as usual Louise.
And, on the arrest warrents as well. They should of course come first. But for me, that’s been a ‘given’, and I’m already prepared to see them at the Hague, because I know that they already have escape plans, and will be long gone before Inauguration Day.
As for the wall, I was yelling about the OBVIOUS hypocrisy in the ‘gaps’ from the start. Ya know what’s even WORSE though?
Well, guess who’s doing the hard labor of the wall construction efforts here on the far Western part of it? Yep, UNDOCUMENTED WORKERS!!!
I swear, I am not kidding or even exaggerating.

Agreed! Right after he signs that arrest warrent for certain members of the previous administration!!
Now, about that silly wall. I think April Fools Day was the perfect day for one of the fools of the “Administration of All Fools” to push on with this foolish project!
I mean lets take a look at this dent in the border. The perfect standing, highly visible tribute to the dents in the heads of republican leadership everywhere. But lest I be accused of being unfair, it must be noted that more than a few dems display equally large dents in their heads, having indicated they think this is a really swell idea.
So even though this is just one more ugly stain on the backside of America ... it really is funny. The foolishness I mean.
Wall off 670 of the 1950 miles of U.S. Mexican border and what do you have? A 1280 mile gate-way, right?
Right. So maybe we should wall off everything.
That’s even more laughable, cause all along this “security” wall there are gaps. Folks like golfers and ranchers and oil-men don’t want that thing cutting through the land they now use with impunity, so the wall, uh .. skips in spots.
Now if any of these folks who are getting their skip had any real concern about the danger of those bad old immigrants rolling across the borders, they’d realize all the bad-ol-un’s will focus on their holes! So, either they’re not smart enough to figure that out, or they know darn full well, no-ones coming through their holes, cause the whole thing is a monumental fraud.
I’ll bet my last roll of toilet paper, somebody, somewhere, with ties to the GOP is making a bundle of money building that wall.
And the concerned worry.
Not about our image.
Not about the foolish waste of money.
Not about the farms and schools and subdivisions getting sliced through, but the environment.
Stop everything else that’s mucking up our environment, and I might be impressed!
Maybe this should be called chapter 2555 of the best selling, but poorly critiqued “Bush Follies” - subtitled - “Dim Dems Too”
But we cant give all the credit to them.
No indeedy.
Hats off to Mr. Chertoff, that grand old man of Israeli and United States citizenship. Must be an enormous source of pride for him to know, he will be remembered in history as the guy who brought Israel’s Apartheid Wall to America.
So after I get through gagging, I’ll sit back and have my good laugh.

Some while back, on another thread, I defended the position of Lou Dobbs. He was at the time making a strong case for border security, while explaining that the strong border would benefit the middle class.
Dobbs (like our current crop of politicians) is a self absorbed conceited egomaniac with an advanced case of self-worship.
He is now pushing the Mexico wall, and attempting to bully governors into accepting a back door version of a national identity card, blackmailing folks who appreciate the fourth amendment with threats of “privilege suspension” Dobbs is an asshole… I was wrong.
The driver’s license is a license to drive, traditionally issued by state governments. The DHS is a usurpation of State powers, and another unfunded mandate (why should citizens who are mostly poor and never fly, pay security costs for citizens who are mostly well-off and fly all the time?) Where’s the left and its “regressive tax” argument?
At some point someone is going to be forced to stand up against the assault on our RIGHTS!
The requirements to obtain a driver’s license, that go beyond determining your ability to operate a motor vehicle are now far too onerous… I can no longer comply.
