U.S. District Judge Henry H. Kennedy, who in June 2005 ordered the Bush administration to protect “all evidence and information regarding the torture, mistreatment and abuse of detainees” at Guantanamo Bay, has now ordered the administration to explain why it destroyed two videotapes of such treatment just five months later.

The judge was not persuaded by the Justice Department’s argument that his order didn’t apply because the abuse recorded on the tapes did not take place at Guantanamo.

AP:

A federal judge on Tuesday ordered the Bush administration to defend its decision to destroy videotapes of CIA interrogations of two al-Qaida suspects.

In a one-sentence order, U.S. District Judge Henry H. Kennedy rejected calls from the Justice Department to stay out of the matter and told lawyers to appear before him Friday at 11 a.m.

In June 2005, Kennedy ordered the administration to safeguard “all evidence and information regarding the torture, mistreatment and abuse of detainees now at the United States Naval Base at Guantanamo Bay.”

“why it destroyed two videotapes of such treatment just five months later”

Because they know they can and get away with it.

The CIA’s arguments fly in the face of current technology. They claim that to reveal the tapes would pose a threat to the identities of interrogators. What nonsense! Didn’t this bunch ever hear of pixilation or “the smudge” or “the big black dot” to obscure the faces of people on tape ...and voices can be altered too.

The laughable part (if this weren’t so serious)is that over and over again, George Bush, Dick Cheney and other administration officials denied the existence of any secret prisons outside the USA. Now the CIA’s central argument is that Kennedy’s order only applied to Guantanamo ...and that the tapes were of prisoners being held at secret prisons elsewhere.

I so wish the major news organizations would start replaying the disclaimers to these secret prisons side by side with the CIA’s current argument. Black - white - stark contrast of lies being exposed for what they are ...evidence of war crimes. This should be done over and over until it sinks into the heads of the American people that THIS IS WHAT WE’VE BECOME.

Where is an Edward R. Murrow when we need the likes of him most?
