Bush: You Get Mukasey or No One at All

Mukasey and Bush
nytimes.com

President Bush issued an ultimatum of sorts on Thursday over his embattled nominee for attorney general, Michael Mukasey, who refuses to say whether he considers waterboarding a form of torture. Bush said if the Democrats block the nomination, it “would guarantee that America would have no attorney general during this time of war.”

AP:

President Bush sought to save Michael Mukasey’s troubled nomination for attorney general Thursday, defending the retired judge’s refusal to say whether he considers waterboarding torture and warning of a leaderless Justice Department if Democrats don’t confirm him.

“If the Senate Judiciary Committee were to block Judge Mukasey on these grounds, they would set a new standard for confirmation that could not be met by any responsible nominee for attorney general,” Bush said in a speech at the Heritage Foundation, a conservative think tank.

“That would guarantee that America would have no attorney general during this time of war,” the president said.

#”...Moral had never been so low in the Justice Department? Betcha Moral has moved up a notch since Gonzales has gone home to be with his family….”

Amazing how morals have improved by NOT having an attorney-general, uhh. Says a lot for the American system of law. But, “not having an attorney general”, if the senate rebuffs this one, could create an excuse for the Bush Neocons to declare martial law!!! Why else do you think they continue to refer to “America….. during this time of war” - even though there is no war (Iraq is NOT a ‘war’)???

Recall in the congressional hearings earlier this year, we learned Moral had never been so low in the Justice Department? Betcha Moral has moved up a notch since Gonzales has gone home to be with his family. [Wonder how moral is there?]

Lets just leave the Department be for a while and give them a chance to show the world, and the prez how the wheels of justice are supposed to slowly grind?

Just chuckled my way through Douglas Chalmers last post. (#111489)

Hi Don,

Just wanted to give some ‘thoughts’ to your question on Blackwater being free to muder at will, and maybe just provide a few links for your reading –pleasure-? (we know not really).

But, to tell you honestly, they’ve been doing this for as long as they’ve been operating in Iraq, (and they were let loose on the people of New Orleans as well, during the horror of hurricane Katrina, which obviously made the horror that much worse.)

But, I said that to say that as far as their ‘immunity’ goes, it’s been that way from the beginning. “Condi the Rice” recently said that there was a ‘loophole’ in the law that allowed for this, but it’s not a ‘loophole’ at all. In fact, this ‘immunity’ to kill with impunity was written into the original contract for the Coalition Provisional Authority by Paul Bremer when the US first set –up it’s formal occupation of Iraq. In the below article, it is noted as decree #17, of those 100 orders, though I thought it was #18. Regardless, the US Administration set this up for them to do whatever the hell they want in Iraq and elsewhere, and not answer to a single body or soul. And, that’s exactly what they’ve been doing, for better than 4 years.

Anyway, here are a few links to some recent activity on this. The Iraqis have passed some legislation that would lift this immunity, but again, in all honesty, I don’t think it’s going to make a lot of difference, because there’s another recent piece (which I can’t find right now) that claims the US military will now take over supervision of Blackwater in Iraq. Like that’s gonna change anything. I mean, if we’re honest in recognizing that the entire occupation is illegal, and the most gigantic violation of all International Laws, it’s pretty obvious that this isn’t going to change anything. Iraq has demanded that Blackwater leave, but of course the Thugs in DC aren’t about to do that, so…they’ve offered this US military oversight as an alternative. It’s all pretty disgusting.

So, here’s some more info on it for now. I do have some other links that I can get to you later, if you’d like to hear more, or follow up on it.

Iraq Bill Would Lift Contractor Immunity
  By Sinan Salaheddin
  The Associated Press

Iraqi government spokesman Ali al-Dabbagh said the draft law approved Tuesday would overturn an immunity order known as Decree 17 that was issued by L. Paul Bremer, who ran the American occupation government until June 2004.

Mideast Dispatches by Dahr Jamail

When Blackwater Kills, No Questions Asked.

You’ll probably have to google or find this piece from a search engine, since I don’t have a link for it. (comes to my mail via a subscription to Mideast Dispatches – Dahr Jamail.

So, you can find additional stuff if you check under his name, (Dahr Jamail) because he’s been reporting from Iraq, (along with other independent correspondents) for at least 3 or 4 years now. (something like that). And, he also has a new book out. “Beyond the Green Zone”.

I’ve found his Mideast Dispatches to be very helpful to my own work over the years, because at the beginning, there was NOTHING in the main stream media to give us any clear picture of what was taking place on the ground in Iraq.

Hope this is helpful.

I’ve been waiting for a column regarding immunity for the Blackwater contractors.  Apparently, the immunity given includes murder.  How can this be?  In discussing the appointment of a new attorney general, no mention has been made of this immunity.  Where does the United States get off on immunity.  That is what Germany allowed in the extermination of the Jews during the Holocaust. The Trials of Nuremberg proved there is no such thing as immunity for murder.

Is not anybody enraged enough to at least write a column about this travesty of justice?

“Oh we gave the contractors immunity for murder.  We cannot go back on our word.”  I thought even following orders did not get one off the hook for murder.

And here we have a possible attorney general who cannot give a definition of torture.

Does anybody have any guts to stand up for JUSTICE in our Senate?

But it is the immunity thing that absolutely stuns me.

Even if the Blackwater contractors fired on those people in self defense, the State Department has issued a statement saying that if murder did happen, the perpetrators are immune from prosecution.

Does that give pause for thoughts with any one?

Your thoughts!!!

fake related news:

President Bush came to the defense of his embattled nominee for the post of Director of Military Detainees. The nominee, General Hucksby, has come under fire from Democrats for ambiguous answers regarding a form of interrogation known as fingernail-pulling.

General Hucksby refused to say whether this practice constituted torture, as he had not been briefed on the subject. Several Democratic Senators said that they would have difficulty confirming a nominee who did not recognize torture when he sees it.

In his news conference, President Bush excoriated the Democrats for ignoring national security in the midst of a war on terror and instead focusing on extending the federal government into health care for poor children. He pointed out the gross unfairness in asking General Hucksby to decide whether fingernail-pulling is torture, saying, “because, you see, the use of this technique is classified”.

If a person seeks appointment to any position that will represent my country then that person must have the conviction of character to completely answer all questions asked by the people.

Michael Mukasey worked for the firm Patterson Belknap Webb & Tyler early on in his career, then went back to the firm last year apparently for more money.  He also worked with none other than the infamous Rudy Guiliani. According to Law Blog.com:

“He and Rudy Are BFF: Here in the Big Apple there is a small, tight group surrounding Giuliani, and Mukasey has a place in that group. They worked together at the U.S. Attorney’s office in Manhattan, and Judge Mukasey swore Rudy in at both of his mayoral inaugurations; the buzz has been that should Giuliani become president, Mukasey would have a prominent role in his administration.”

This article also says:
““Show Me the Money!”: When he stepped down from the bench last year to rejoin Patterson Belknap Webb & Tyler, he made no bones about the fact that the move was about money. “If I’m going to do something else at any point in my career, now would be the time to do it,” said Judge Mukasey to the Law Blog. Citing financial considerations as a factor, Judge Mukasey added”

http://blogs.wsj.com/law/2007/09/17/seven-tidbits-about-michael-mukasey/

Patterson Belknap Webb & Tyler is an “A list” firm who had, according to a Law.com article:

“Patterson weathered a rocky financial phase in the early 1990s, even going so far as considering a merger. But partners say the firm now has a solid base of litigation clients—notably Johnson & Johnson, Abbott Laboratories and Dow Jones & Co. Inc.—and one of the nation’s most prominent tax-exempt organization practices, representing The Frick Collection, the Rockefeller Brothers Fund and the United States Tennis Association, among others.”

But then things started looking up, the article states:

“Despite this year’s dip in financial returns, Patterson’s numbers have actually improved dramatically over the last decade. From 1998 to 2005, Patterson’s PPP grew 141 percent, from $470,000 to $1.135 million—almost twice the 72 percent average growth rate of firms in The Am Law 200. During the same period, the firm’s RPL grew by 66 percent—from $495,000 to $820,000—beating the Am Law 200 average RPL growth rate of 48 percent.”

Notice the familiar names in the client base and the sudden jump recently in profits.  This taking place when? Between 1998-2005.  What a coincidence, I think that’s when Blackwater had their good fortune.  When you see the name Rockefeller “anything” run like hell.  Not to worry there’s also some other familiar names, the article goes on:

“A major reason for Patterson’s growth was the firm’s move in the early 1990s into high-stakes patent litigation, a decision spearheaded by Diskant, Cavanaugh and former partner David Dobbins (he is now of counsel). The patent litigation practice began when the firm took on a few important medical device cases for a subsidiary of longtime firm client Johnson & Johnson. It has since grown to one-third of the firm’s litigation docket, with a blue-chip client list that includes J&J;, General Electric Co., Abbott Laboratories and Siemens AG.”

I hope the Senate does not confirm another one of his cronies as they all work against us and our country. I am especially concerned that Senator Schumer may support this nominee for reasons that are unknown to us. I hope our media will turn up some of these conflicts of interest.

I want my nomination approved, stomp-stomp, wheeze! Is congress trying to act like congress or what?

Yes, Congress has set a new standard - it’s called integrity!I realize that this is a foreign concept to this administration, even when the president huffs and puffs, stamps his little feet (without cowboy boots), and says if you don’t approve my boy we will just do without an attorney general!

Can the country exist without a Attorney General? Of course, it has for the past several years. One would be hard pressed to say that Gonzo was an attorney general - he was really an attorney private.

However, if congress shows some spine they can indeed pressure the president to do his job - and appoint someone else.

To water board or not water board is not the real issue - the real issue is can we find someone who is not the president’s flunky?
