An Oregon lawyer and convert to Islam has settled his lawsuit against the FBI for $2 million. Brandon Mayfield, who sued after he was falsely linked to the Madrid train bombings, described his experiences as an Orwellian nightmare where “an act that strips you of your civil rights could be called a Patriot Act.”

Brandon Mayfield, the Portland-area lawyer wrongly linked to the deadly Madrid, Spain, train bombings of 2004, accepted a $2 million settlement Wednesday in his lawsuit against the federal government, setting up a legal showdown over the constitutionality of the USA Patriot Act.
The United States will pay the convert to Islam $1.9 million for the emotional toll he suffered from two weeks of imprisonment as a material witness to a crime he knew nothing about, with another $100,000 going to his wife and three children for their suffering.
The government also agreed to destroy all materials seized from Mayfield’s home and office. And it agreed to issue the 40-year-old lawyer another apology for FBI foulups that matched him to a fingerprint found in Madrid, leading to his investigation as a possible terrorist.
... At a news conference Wednesday in a downtown Portland high-rise, the lean, bespectacled lawyer likened his ordeal to an Orwellian nightmare.
“I am talking about the George Orwell frightening brave new world in which Big Brother is constantly watching you, complete with 24-hour surveillance, thought control and doublespeak,” Mayfield said. “Where war means peace. Freedom is slavery. Ignorance is strength. Where torture is morality. And an act that strips you of your civil rights could be called a Patriot Act.”

Comment #40421 by Socrates quotes the fourth ammendment to our Constitution.
BUt the fourth ammendment has been whittled down by congress and the courts to where it is unrecognizable.
Here’s another outrage for consideration:
Where in the founding documents is there a provision allowing the government to “grant privilege?” the answer is nowhere. Our founding fathers distrusted the idea of “privilege which came from “the crown” and was granted in the form of knighthoods, earldoms, and Barrondoms. They expelled “privilege” from their new society.
BUT
in the Twentith century “privilege” was introduced through the State governments and their 50 driver’s licensing laws.
Now in yet another end run around the fourth ammendment States are requiring Social Security numbers as provision for “keeping the privilege’ of using a driving license.
For those who are unaware one’s social security number unlocks the door protecting your financial information. ALL OF IT. imprinted on the magnetic strip on the back of your license it allows anyone with a decoder to determine where you work, what you make, what you buy with checks or plastic, and where your political sympathies lie (as indicated by contribution.)

This FBI behavior has never been just about little mistakes and incompetence. It has been a malevolent gestapo in our nation since the early
1920s when the “Palmer Raids” expelled many radicals from the country including Emma Goldman.
Under the U.S. Attorney General Palmer, that moral runt of the litter, J.Edgar Hoover, was the first head of the FBI. He lasted 50 years until 1973 as racist handmaiden to the southern white trash in Congress and the reactionary, pro- Fascist Republicans. This Klavern is full of malevolence, and still has its national H.Q. named after Hoover some 33 years after his death.
This is why it is so quick to victimize,harass, bully and intimidate Americans from liberal to the progressive left, when a reactionary president like Butch the Second comes to power, and all the Congressional whores, Demicans and Republicrats conspire to sell our rights and liberties down the river.
Without murderous scum like Gonzales as U.S. Attorney General, this latest crew of Federal thugs would never have dared to be so careless and contemptuous of this victim’s legal rights.
Fortunately he knew how to fight back, and we can only hope every other American patriot will rally to the cause of moral revolution to crush this “Axis of Evil” in our own land that is 1000 times more dangerous than a few rabid terrorists scattered around the globe.

You know, this brings up the issue of incompetence. We really do need the FBI, but it appears that they are an empty husk of an organization full of too many keystone cops. After this and many other embarassing episodes in the past years we might want to seriously start looking into whether ex-FEMA head Michael Brown’s brothers are running the FBI lately. I feel bad for the good people there who are trodden over by the idiots at the helm. Seriously, they need a purge, because we need them to do a proper job!!! In this case, the FBI spokesman says “our investigation was extremely thorough and extremely professional.” Brings back memories of “Brownie, you’re doing a heck of a job!”
No wonder they want the Patriot Act, they need the handicap.
Mayfield’s case is a slamdunk in the Supreme Court. I just found this little bit, tucked away in the constitution, which is crystal clear on this matter...maybe somebody should bring this to the attention of the FBI, send a memo or something:
Amendment IV: The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

The recent evolution of the FBI’s use of the phrase: ‘person of interest’ has destroyed so many innocent US Citizen’s lives.
It is nice to see the guy get the dough, BUT there is NO INDICATION that the FBI managment responsible for this miscarriage of justice has been held accountable.
Continuing, there is no indication that the FBI’s capacity for this type of ineptitude & misconduct has been corrected.
Even more unsetteling is the concept that this type of Barney FIFE law enforcement investigative capability offers the American citizen minimal return on our tax dollars and deterence from being preyed upon by villans.
Years ago, when the Brits became aware of diminished capacity by Scotland Yard, it was reorganized & retitled ‘The New Scotland Yard’.
It is predictable that upon the next disaster, once again the FBI will request: more computers, more agents & support personnel and cars.
We can not keep throwing money at a flawed system. It is even worse when you look at the consolidation of investigative effort under the auspices of the FBI. Once again it is the unintended consequenses of the systems vulnerability to management egos and individuals such as convicted former FBI Agent Robert Hannson.
Sadly, the FBI will be agile in being able to protect & continue to engrandise their ‘turf’ because they hold the trump card in that so many of the appointed positions within our government require FBI ‘background’ check(s) & have a very nasty habit of leaking investigative information to the press under the guise of FBI sources not wanting to be identified.
The infection of this type of ‘clique’ continues into the local law enforcement management with the adroit use of the FBI’s selection of individuals to attent its Quantico based ‘National Academy’. The NA is highly regarded by local law enforcement officers as a ‘employment re-entry point’ for subsequent to retirement law enforcement jobs ... both public and private.
The investigative crucifixion of the Maryland chemist regarding the Anthrax dissemination is a reflection of the above ‘trial in the press’.
One can only wonder how many villans have escaped justice, how many innocent people lives have been ruined and what maginitude of misfortune is in our future because of the FBI’s structure & management attitude.
Again:
WHO was held accountable?
WHAT, specifically, was done to those involved?
WHAT has been done to prevent this from happening again?
Keep shining the light of factual reporting upon this incident in the hope that our rights as citizens are preserved.

Here in Portland Mayfield’s case has enjoyed a remarkably optimistic outcome. The really sad case is that of the Portland 7, the little cell of zealots based out of Mayfield’s own mosque. Some of them travelled to China trying to enter Pakistan to aid in refugee camps. They were accused of trying to join the Taliban as combatants. They never actually did anything. They couldn’t get into Pakistan. The lot of them were convicted as coconspirators mainly on a case built around supplying a fire arm to an FBI agent provocateur in response to his fantastic story of harassment and fear for his life. Of course this guy was nowhere to be found at the time of the trial. They were literally scared into cutting a deal, initially a fairly lenient one. But Ashcroft’s office demanded severe punishment for this pathetic band of foolish scape goats. The Portland 7 are serving terms of from 8 to 18 years. There is now a cause celebre growing to free them. Obviously this is the sort of easy prey the FBI readily fries and serves up to eager prosecutors like Ashcroft, to please their taskmasters, in this case to further weave their elaborate myth of Islamo Fascism — the over arching pretext for their endless War of Terror and ultimate Clash of Civilizations.
